After Preliminary Investigation at the Magistrate Court for various offences, Magistrate Mark Ngegba has sent Alimamy N’jai Sesay a student at Fourah Bay College to the High Court for trial without bail.
The accused made his last appearance before Magistrate Mark Ngegba of Court No. 1 on Pademba Road, Freetown, after 15 appearances.
The convict was charged on 5 counts ranging from Cyber Stalking and Bullying, Sending Hatred Messages by means of Computer System/Network Contrary to Section 44 (2) (b) of the Cyber Security and Crime Act 2021, Act No. 7 of 2021, Sending Enmity Messages by means of Computer System Network with intent to provoke the Citizens of Sierra Leone to Commit the breach of peace, Distributing Racist Material to the Public through a Computer System System, Contrary to Section 51 (1) (a) of the Cyber Security and Crime Act No 2021, Act No. 7 of 2021, and Public Insult through a Computer System Contrary to Section 52 (1) (C) of the Cyber Security and Crime Act 2021 Act No. 7 of 2021.
According to the charge sheet on count 1, the convict Alimamy N’jai Sesay on Friday 1st July 2022 in Freetown, as an individual send insulting messages created by Abdul Will Kamara alias Adebayor against the Government of Sierra Leone by means of computer system/network with intent to provoke the citizens of Sierra Leone to commit the breach of the peace.
Count 2 states that the convict Alimamy N’jai Sesay on Friday 1st July 2022, through social media platform via WhatsApp and Facebook in Freetown, as an individual send hatred messages created by Abdul Will Kamara alias Adebayor against the Government of Sierra Leone by means of computer system/ network with intent to provoke the citizens of Sierra Leone to commit the breach of the peace.
Count 3 states that the convict on Wednesday 10th August 2022, through social media platform via WhatsApp and Facebook in Freetown, as an individual send enmity messages created by Abdul Will Kamara alias Adebayor against the Government of Sierra Leone by means of computer system/network with intent to provoke the citizens of Sierra Leone to commit the breach of the peace.
Count 4 states that the convict between 1st July and Wednesday 10th August 2022, through social media platform via WhatsApp and Facebook in Freetown, disturbed racist material created by Abdul Will Kamara alias Adebayor against the Government of Sierra by computer system/network with intent to provoke the citizens of Sierra Leone to commit the breach of the peace.
count 5 states that the convict on the same dates and place through social media platform via WhatsApp and Facebook in Freetown, as an individual publicly send insulting messages created by Abdul Will Kamara alias Adebayor against the Government of Sierra Leone through a computer system with intent to provoke the citizens of Sierra Leone to commit the breach of the peace.
Five (5) witnesses testified including two (2) Cyber Officers from CID, the investigator and the Exhibit Clerk.
Sergeant 9155 Dwight Macarthy Prosecuted the matter.
