Magistrate Alpha Ndolleh of Sefadu Magistrate Court at D.O. Barracks in Koidu City , Kono District has issued a bench warrant for the Proprietor of Mama Salone Hospital situated along 179 Wilkinson road in Freetown for failing to avail himself in the aforementioned court on Tuesday 15th November, 2022 for allegedly threatened to kill a business man in Koidu City named Ali Adel Khalil; after allegedly participating in the divorce proceedings of Mr and Mrs Khalili.
The said bench warrant was issued as a result of the request made by the Solicitor for the complainant Mohamed S. Samura Esq. Projecting his reasons for the issuance of the said bench warrant , Mohamed S. Samura Esq. quoted sections twenty two ( 22) and twenty three (23) of the Criminal procedure Act 1963 Act number thirty two (32) noting section twenty two (22) stated that notwithstanding the issuing of a summons a warrant may be issued at any time before or after the appointed in the summons for the appearance of the accused.
The legal luminary further pointed out that section twenty three (23) of the same Criminal procedure Act 1963 Act number Thirty two (32) maintained that if the person issued with a summons does not appear at the time and place appointed in and by the summons and his personal attendance has not been dispensed with under section twenty one (21) the Court may issue a warrant to arrest him and cause him to be brought before such court.
It was on that backdrop the resident Magistrate of the Sefadu Magistrate court granted the said request and issued the bench warrant for the Proprietor of Mama Salone Hospital in Freetown Dr. Mohamed Elzayat and wife.
