High Court Judge Justice Adrian Fisher of High Court no.1 in Freetown has stroke out the bail application made for Laj’s brother and ten others and ordered both counsels to file written synopsis before September 14th 2022.
According to Justice Adrian Fisher’s ruling, states that the appellant amongst the issues highlighted by counsels relied on the entirety of the affidavit and argued that the two grounds that formed the basis of the Appeal are not summary offences.
Justice Fisher informed the court that the appellants are first time offenders with good grounding or prospects of success.
The judge said he has listened to both arguments made by both counsels and he will look into the law whether bail should be granted.
Justice Fisher also said Counsel for the plaintiff failed to state the law that will warrant the appellants to be granted bail pending the hearing of the Appeal and also said Counsel for the appellants failed to state the law that will grant the bail Application.
Justice Adrian Fisher stated that Magistrate Mark Ngeba of Magistrate court had convicted Laj’s brothers and 10 others on two counts charges of riotous conduct and disorderly behavior and sentenced them to 18 months imprisonment on each counts.
High Court Judge Justice Adrian Fisher said Counsel for the Appellants Pa Momoh Fofanah made an application for bail on the 19th July 2022, through a notice of motion seeking that bail should be granted to the convicts referring to section 67 (21) of the court No.31 of 1965 and the application is supported by the appellants affidavit.
Justice Adrian Fisher adjourned the matter to the 20th September 2022 for hearing.
