Wounding with Intent: Justice Bonnie adjourns for ruling

Justice Hannah Bonnie has adjourned an alleged wounding matter for  judgment between the state and Kamanda Kargbo to the 5th of July 2021.

The accused was arraigned before her for proper trial after the criminal session call over on two count charges of Causing grievous bodily harm and wounding contrary to section 20 of the offences against the persons Act of 1816.

It was alleged that on the 5th July 2020, the accused caused grievous bodily harm and also wounded complainant Edward Jusu.

Shortly after the matter was mentioned yesterday for further hearing counsel for the state A.P Hasting Spain dock an additional witness sergeant Brima Sama attached to the law officers department who explained before the court how went to server a subpoena to witness Alhassan Sankoh but to no avail.

The police officer further told the court that he enquire about the where about of the witness but complainant told him he is not residing at the address given to the police . Counsel for the state also applied for Alfred Conteh whose name was not in stated in the book of the indictment to be call as an additional witness in order to ascertain the fact that the witness was indeed subpoena by the court.

She said her action was not to create in justice sitting section 188 of the criminal procedure Act 1965.

Granting his application Alfred Conteh took the witness and give his occupation as one of the High Court Registers he produce a court file with case file number 15/2020 bearing the name  of the accused Kamanda Kargbo. He also produces the deposition of the absent witness Alhassan Sankoh which according to him was signed by the police.

In that light the state prosecutor declare that as the case for the prosecution the accused was put on his selection and told the bench that he relied on his statement made to the police during investigation.

However Justice Bonnie adjourned the matter to 5th July 2021 for him to think of a plea before judgment.
