A private driver (Musa Kamara) was in court as First Prosecution Witness (PW1) to testify in a matter where Kelley Fofanah and Sulaiman Jalloh were allegedly accused for wounding and assault. They were before Magistrate Sahr Keikura of Court No.1 Pademba road Freetown on the 18th May, 2021.
According to the police charged sheets, the accused persons were charged with two counts charges, count one wounding and count two assaults contrary to section 20 of the Offence against the Person Act 1861. It is alleged in count one that Kelley Fofanah on the 5th April, 2021 at Dodo Adonkia Goderich wounded Musa Kamara with intent to do him grievously bodily harm.
In count two it is alleged in count two that Sulaiman Jalloh and Kelley Fofanah assaulted Musa Kamara in a manner thereby occasioning him actual bodily harm.
Testifying in court, PW1 (Musa Kamara) said he knew the both accused persons at Dodo Adonkia Goderich Freetown. The witness said on the 5th April, 2021 he left to visit his land at Dodo Adonkia Goderich and upon arrival he saw both the accused persons and Pa.Tommy was pointing his finger at him that he is Musa Kamara. Witness said the first accused person went with stone and hit him on his mouth and felt pain and wounded him. Witness continued to say the second accused person went to hold him and dragged him from the hill side to the street.
He furthered that he was wounded and the first accused person bite him and later people came to separate them and rescue him. The witness said he later went to the Adonkia Police Station to make a statement and later police medical request form was issued for medication and later returned with an endorsed medical form after the medical treatment at the Lumley Government Hospital, Regent Road Lumley.
During cross examination, defense council Elvis Kargbo asks the witness if he has knew the accused persons for long time. Witness said he has known them for long time. Defense council continued to asks if he knew Pa-Tommy. Witness said he knew him for this matter. Defense counsel asks the witness if he has went with the accused persons to local court before. Witness said yes. Defense council asks how many police officers were at the scene. Witness said the officers that saw were four. The Magistrate granted bail in the sum of 20,000,000/00 plus one surety each and the sureties must be resident of Freetown.
The State Prosecutor prosecuting the case is Inspector Komba A. while Lawyer Elvis Kargbo represented both accused persons. The accused person is on bail and the matter was adjourned to the 28th May, 2021.
