First Police Witness (PW 1) and also the compliance officer of the Commerce and Mortgage Bank, Aminata Alima Sesay has testified before Magistrate Mark Ngegba on the 28th April, 2021 at the Pademba Road Court in Freetown in a matter filed under private criminal summon between Michael D.Kamara and Janet Tucker for a certain land located in Bo district, in the Southern Province of Sierra Leone.
When testifying in court, PW1 said she is aware of a joint account number 002-105-297-1354. The witness said the account has been in their custody as a joint account for Mr. Michael D.Kamara and Madam Janet Tucker. She said Mr. Michael D.Kamara has been transacting with the account as he normally withdrew monies from the said account at the bank. Witness said she brought to court the bank statement of the said bank account with the total of money of thirty four million, seven hundred and eighty four thousand Leones (Le 34, 700, 84,000/00).
Under cross examination, Defense Lawyer E.M.B Sesay asked if the witness is the complaisance officer of the said bank. The witness said she is. Defense lawyer asked about the nature of account that his client is operating with the bank. Witness said it is a join account. Defense lawyer asks if there is a signatory mandate. The witness said, the court only requested for bank statements. Defense lawyer asks if she knew the defendant. Witness said no. Defense lawyer asked how long the witness has been a banker. Witness said for three years. Defense lawyer asks why the witness doesn’t want to talk about the signatory mandate. The witness said the court requested from the bank a bank statement.
A.Kondowa, E.S. Musa, A. Dumbuya represented the complainant, whiles E.M.B Sesay represented the defendant. Matter has been adjourned to the 5th May, 2021.
