Justice Adrian Fisher has during the judiciary week discharged the case of manslaughter against Alimamy Kargbo who was accused of unlawfully killing his colleague Mohamed Sheku  in 2016.

Haven spent almost eight years in custody at the Male Correctional Center in Freetown, Kargbo the accused has pleaded guilty of the crime before Justice Fisher.

The state prosecution led by Daisy Sawyer in agreement with the defense counsel led by Ibrahim Bangura made an amendment on the charge from murder to manslaughter.

Police alleged that the accused on 14th May 2016 in Freetown judicial District unlawfully killed Mohamed Sheku .

According to state lawyer Daisy Sawyer in her closing remark said the deceased Mohamed Sheku on the 6th May 2016 went to the shop where he work together with the accused as apprentice and did not meet the accused. When Sheku called the accused he told him that he was watching movie in a nearby house. Upon his return the deceased told him that he will report his attitude to their boss. This caused the accused to be angry, he rushed inside the shop and came out then he told the deceased to point at him again if he was man enough.

She continued that when the deceased pointed at him again unknowingly that the accused had a knife, Kargbo stabbed the deceased at the back of his neck, on his forehead and left him on the ground and ran off.

Lawyer Sawyer furthered that the deceased managed to call for help and was taken to the hospital and died a week later. She said Dr Simeon Owizz Koroma had given the cause of death which they have tendered in their case file.

In his concluding remarks Legal Aid lawyer Ibrahim Bangura pleaded with Justice Fisher to be merciful to his client and consider the time he has already spent in custody. He said his client has learnt his lessons and will be a good person if dismissed.

Speaking for himself before Justice Fisher, Kargbo the accused pleaded guilty to have killed his colleague worker but claimed that the act was done out of self-defense.

The accused said he has never been in police for any crime before and it was not something he planned. He also promised the court that with the help of God he will never again be involved in any crime.

“I will return to Batkanu immediately, if I am freed today,” Kargbo promised.

He said his father is living in Batkanu while his mother and daughter have died.

Justice Fisher after listening to the accused, in his ruling strictly warned the accused to behave himself and stay out of trouble.

Justice Fisher has acquitted Kargbo of all charges and dismissed him due to the time spent in prison.
