Defence Lawyer A.D.B John for Edward Gray, the accused person who was dragged to court for manslaughter, has promised to make a no-case submission on behalf of his client on the next adjourned date slated for the 17th of May, 2023.
Lawyer John made the above disclosure shortly after the prosecutor Assistant Superintendent of Police Osman Mohamed Bangura informed the Bench that he has close the case for the prosecution.
The accused Edward Gray is charged to court after a police investigation for manslaughter with his information attached to case file number C/S 2728/ 2022.
According to the police charge sheet on Tuesday 20th September 2022, at No. 22 Old Railway Line Brima Lane, the accused unlawfully killed Damn Marie Fudia Mansaray his fiancée.
An abstract report in the police file that a report was made against the accused that at about twelve midnight, the accused assaulted his fiancée, Ann Marie Fudia Mansaray and as a result, she loses her life.
Shortly after the matter was mentioned on the 12th May 2023, the prosecutor Assistant Superintendent of Police Osman Mohamed Bangura informed the Bench that he has closed the case of the prosecution.
Rising from the bar on behalf of his client, defence counsel ADB John said he is going to make a no-case submission challenging the evidence that the prosecution has led so far against his client.
Hearing that, magistrate Sahr Kekura said the burden of proof lies on the head of the prosecution who is expected to prove its case beyond all reasonable doubt.
Magistrate Sahr Kekura adjourned the matter to the 17th of May 2023, awaiting the defence.
