The Resident High Court judge in Kono Judiciary District. Justice Augustine K Musa has sentenced Abu Marrah and Patrick Kamara each to eighty and seventy years imprisonment respectively. Each of the Convicts is to run his jailed term concurrently.
According to the particulars of offence Abu Marrah the first Convict was standing trials for sexual penetration contrary to section nineteen (19) of the sexual offences Act 2012 Act number twelve ( 12 ) of 2012, As Repealed and Replaced by section four 4 (a) (111) of the sexual offences Amendments Act 2019 Act number 8 of 2019 and meeting a child for sexual purpose contrary to section 23 (1) ( A) of the sexual offences Act number 12 of 2012. The particulars of offence maintained that Abu Marrah Committed the offence on Monday 16th May, 2022 at Komao town in Nimikoro chiefdom, Kono District by penetrating a thirteen year old pupil name withheld.
Meanwhile, the medical report shows that the hymen ruptured completely and was not fresh. The state counsel Lawyer Charles Foday Sesay led Several prosecution witnesses to prove his case beyond all reasonable doubts. Pw 1 the survivor told the court how she was sexually penetrated after the convict sent her to buy cigarette and later forced her into his room when she was vaginated. Base on all the evidence tendered in court coupled with the exibits and the medical report, the convict was sentenced to forty years on each count and should be served concurrently.
In a similar ruling at the aforementioned high court holden, Patrick Kamara was also found guilty of sexual penetration and meeting achild for sexual purpose. The particulars of offence states that the convict Patrick Kamara sometimes in December, 2021 at Gbekor Village in Nimikoro chiefdom Kono District engaged in an act of sexual penetration with a girl under the age of eighteen (18) to with sexual penetration. The medical report states that the hymen raptured completely. Same prosecution witnesses were led by lawyer Charles Foday sesay. The defence lawyer from legal Aid Board lawyer A O kamara represented the two accused persons throughout the trails. When the accused persons were found guilty at plea mitigation, lawyer A O kamara convassed the judge to temper justice with mercy as the convicts have learnt a lot during the trails and promised to change for good.
Ruling on the matter Hon. Justice Augustine K Musa noted that sexual offences are prevelence in the District and that the law must clamp dawn on perpetrators to protect the girl child in the fourteen chiefdoms that Constitute Kono District.
