Police witness testifies in Land Saga

The accuse, Hagger Miranda Dumbuya made another appearance before Magistrate Santigie Bangura of Pademba road court No.3 in Freetown on one count charge to wit Trespass contrary to section 15 (1) (b) of the Public Order Act No.46 of 1965.

According to the particulars of offence sometimes in 2021 at peninsular Road York the western area in Freetown unlawfully entered into the land of Philip Jesbert Juana when required not to do so.

Deputy Superintendent of police Sorie Conteh Led third Prosecution witness (PW3)Sergeant 16430 James Bassie Kanu attached to the Land force grabbing said he recognized the accused person and also the complainant.

 Pw3 said  he recalled on the 4th October 2022 when the complainant reported a case of trespass against the accused person and the matter was assigned to him for investigation.He said the land in question was visited by a team of police officers headed by him at York village, the accused person was cautioned on the 6th October 2021.

 The witness added that during the process Sub inspector Kargbo D.B and himself cautioned and questioned the accused person in krio language, and the said caution statement was read over and explained to the accused person which she admitted to be true and correct by afflicting her right hand thumb print.

 Sub Inspector Kargbo D.B sign as the witness and he signed as the recorder since then the said statement was in the custody of the police; the statement was produced and tendered in court to form part of the court records. The witness said the document of the complainant was forwarded to the Ministry of Lands Housing and Country Planning and the said documents was forwarded to the police since then it was in the custody of the police as a response towards the Ministry.

The witness added that on the  17th September 2021 at 11 am for the Land to be resurvey, the technical officer at the ministry of Lands housing and country planning did a resurvey of the said land in presence of the complainant and the accused person after the resurvey base on the findings of the Ministry the accused person was cautioned and charged with the above offence.

Main while, Magistrate Bangura adjourned the matter to the 12th December 2022 for further hearing; bail continue for the accused person.
