Mohamed Salieu Jalloh a fuel dealer in Makeni has on the 1st Feburary,2022 took the witness stand to testify on how he was attacked on social media by 42yrs years old Ahmed Dolye Kamara.
The accused is before magistrate Sahr Kekura for Preliminary Investigation on two count of Cyber Stalking and misuse of Devise contrary to the Cyber laws.
It was alleged on the charge sheet that sometimes between 1st to 22nd December 2021, through social media via WhatsApp, the accused did recklessly and intentionally send a video message by means of computer system to the entire Fullah tribe that is grossly offensive, indecent, absence, menacing their character for the purpose of causing danger, obstruction, insult, injury, Criminal intimidation, enmity, hatred, ill will and needless anxiety to the said Fullah tribe in Sierra Leone and abroad without consent.
In count two, the police alleged that the accused intentionally or without authorization procure for use, possesses offer to supply and distribute video message against the Fullah tribe for the purpose of committing an offense of insulting and provocation.
Led in his examination in chief, complainant recognized the accused in the dock as someone he saw on a video sent to him on a social media platform.
Between 1st to the 22nd December 2021, at night, one Mr. Abdul Sow sent a video to him with a mobile phone on WhatsApp.
Upon receiving the video, he opens it and detects a lot of invectives with the photo of the accused referring to the Fullah people all over the world.
Complainant said the accused further referred to him as bastered.
Leading further by Police prosecutor Dwhight Macathy, complainant said he left for Hill Station Police Station. Complainant said he was asked to make statement after the report.
Complainant produced the said video in court for both prosecuting and defense counsel to look at it.
On reaching that stage counsel defending the accused M. Sheriff applied for bail for and on behalf of his client. He said his client is a family man, and if granted bail he will not interfere with the witness neither jump bail.
He backed up his application by citing section 79 of the Criminal Procedure Act of 1965, while the Prosecution relied on the affidavit in support to oppose bail.
Having heard from the defense, magistrate Sahr Kekura granted the accused person bail in the sum of two hundred million Leones or one surety in like sum surety to be resident within his jurisdiction, the surety should produce valid identity card depicting his/her address in Freetown, bail to be approved by the Deputy Acting Registrar matter to the 10th February 2022.
