ACCUSED DENIED BAIL FOR FRUDULENT CONVERSION

Sahr Brian Sokenah made another appearance before Magistrate Sahr Kekura of Pademba Road Magistrate court No 1 in Freetown for fraudulent conversion contrary to section 20 (1) (iv) (a) of the larceny Act of 1916.

According to the particulars of offence, the accused person Sahr Brian Sokenah on a date unknown between Wednesday 1st January 2020 and Thursday 31st December 2020, Lowcust Kissy, in the Freetown Judicial District in the Western Area of the Republic of Sierra Leone, fraudulently converted one KIA Sport age Jeep with registration number AQG 858 valued at seven thousand United States Dollars ($ 7,000) equivalent to seventy million Leones (Le 70,000,000/00) entrusted to Kala Kamara for the purpose of sale and as well a property of Magdelene Sesay.

Amid the testament of the accused person, the charge was rendered and explained as no plea was either taken.

The Defence Counsel E.W Conteh applied for bail for and on behalf of the accused person.

He stated that the accused person is a Sierra Leonean ordinarily resident within the jurisdiction of Freetown.

Adding that the accused person has credible surety who is ready to stand in his recognisance.

Defence Counsel E.W Conteh said the accused person is not a flight risk nor will he jump bail.

However, the said application is made pursuant to section 79 (2) of the Criminal Procedure Act No 32 of 1965.

The Defence Counsel urged the magistrate to temper justice with mercy and consider his bail.

Having read out the application for bail on behalf of the accused person and taken into consideration that the accused person is not a first time offender and was hitherto engaged in acts of fraudulent conversion.

Thus, the accused person was thereby refused bail by magistrate Sahr Keikura and so ordered that he remains in custody.

Inspector Kadie Taylor is prosecuting the matter which has been adjourned 2nd February 2022.
