43yrs Pastor Septimus Paul Yambasu made another appearance before Magistrate Sahr Kekura of Pademba road court No.1 in Freetown on one count charge to wit insulting conduct contrary to Section 3 (1) of the public order Act No.46 of 1965
According to the particulars of offence on Tuesday 14th December 2021 along Jui Wilberforce road the western area in Freetown did use obscene and insulting words against the President H.E Dr. Julius Maada Bio with intent to provoke him to commit a breach of the peace.
The charge was read and explained to the accused person, he pleaded not guiltily.
Prosecution witness number one Sergeant 5620 Sorie Ibrahim Kamara attached to the Criminal Investigation Department (CID) headquarters said he recognizes the accused person in the dock on the 13th December 2021 whilst on duties at the said headquarters on Abdul Sillah at No.7 Sakoh Drive assisted by RSL 18181041 Maria Kamara arrested and brought in the accused person and reported that the accused person in the dock insulted the President H.E Julius Maada Bio.
He obtained statements from the complainant himself and inspector A.A Nalloh obtained statements from the accused person.
A.A Nalloh did the questioning in krio the accused person responded in krio and at the end of the statements it was read over to the accused person which he confirmed to be true by afflicting his right hand thumb print.
The charge statement was tendered in court and it was marked exhibit A1-8 on the 15th December 2021 himself and Inspector A.A Nalloh obtained a charge statement for the accused person.
The accused was cautioned and questioned in krio language and at the end of the statement it was read over to the accused it was witnessed by Inspector A.A Nalloh and he signed as the recorder.
The said statement was signed by the accused person it was tendered as exhibit B1-3 he concluded.
Cross examination by defense counsel Lansana Dumbuya, what did you charge the accused person for the witness said insulting conduct against the President H.E Dr Julius Maada Bio.
He was asked if he took statement from the president the witness said no did you obtained statements from the witness he said he obtained statements from him while obtaining the statement the witness didn’t use Abusive language against the president the witness said No.
The witness was asked to read the charge statement by defense counsel in-fact the complainant was one of the passengers in the vehicle the witness said yes, he knew the ingredients regarding insulting conduct especially the effects on whom the insult was directed, to the witness it was an instruction given to him by his boss.
Defense counsel applied that the accused person be granted bail by adopting his previous application on behalf of the accused person.
However Magistrate Kekura granted the accused person bail in the sum of one hundred million Leones or one surety each in like sum, surety must be resident within his jurisdiction, they must be elderly citizens, bail to be approved by the Deputy Acting Registrar.
Sergeant 8998 Kadie M Taylor prosecuting the matter adjourned to the 13th January 2022
