ACCUSED REMANDED FOR MOBILE PHONE THEFT

Tejan Rashid Conteh was arraigned before Justice Ivan Sesay on one count charge of larceny in a dwelling house contrary to section 13 (a) of the larceny Act of 1916.

According to the particulars of offence that the accused person Tejan Rashid Conteh on Wednesday 14th April 2021 at No1 Loomy lane off Benjamin lane Freetown in the Freetown Judicial District in the Western Area of the Republic of Sierra Leone with intent to steal entered the dwelling house of Michael Saidu and stole one black Motorola mobile Phone, one itel button P33, of which the Black Motorola is valued at 850,000 and the itel P33 mobile phone valued at 700,000 all summing up to One Million Five Hundred and Fifty Thousand Leones  (1550,000).

First prosecution witness the complainant (PW1) said the accused was his friend, he said on the 14 April, he said the accused came at his house, and he asked for water and he told the accused he had food, as they were accustomed eating together as friends, he said he went inside of his room to bring out the food and coming outside to meet the accused he couldn’t see the accused person.

He concluded that he ran outside looking for the accused and later saw the accused on a bike and he started shouting the name of the accused person but the accused person ran away, he said he left his phones on top of the refrigerator in order to go bring the food for both he and the accused to eat but the accused hurriedly left and when he came back he was unable to see his phone.

The accused in his voluntary caution statement said the complainant is his childhood friend, and that he went to the house of the accused and saw the complainant alone at his house, he said the complainant offered him food and left to bring out the food, he said he was holding a mobile phone, and he asked the complainant if he was with a charger ass his phone was switched off, he said the complainant answered and was about to bring the said food and the charger when he stole the phone and ran away.

He continued that the complainant came outside and saw him on a bike and the complainant shouted his name but fled off and refused to come down from the bike.

He concluded that on the 24th July he was with his father inside a vehicle when the complainant saw him and arrested and was reported to the New England Vile Police Station.

The state was represented by Y I Sesay whilst the defense counsel was represented by OC Tucker the matter has been adjourned to the 8 Dec 2021.
