An alleged land grabber, Finda Kabba, residing at No.49 Tarawallie Drive Malama Regent Road Lumley and Kabba Kamara of Waterloo are presently in court seeking redress over a piece of land situated at Kerry Town.
The complainant Finda Kabba and defendant has on the 3rd November,2021 before Magistrate Mark Ngegba of Pademba Road court No.2 in Freetown, on a private criminal summon of trespass and malicious damage contrary to Law.
It was alleged on the charge sheet, the defendant Kabba Kamara is alleged to have on diverse dates between 1st January 2021 to 31st August 2021 at Kerry Town, Waterloo district unlawfully entered into the land belonging to the complainant herein in a threatening manner after been warned not to enter same.
On count two, Mr. Kabba Kamara was alleged to have on the same date at the above address in Freetown, maliciously damaged concrete pillars value at three million Leones property of Finda Kabba, complainant herein.
The matter was field by Gevao and Associates, solicitors for the complainant Finda Kabba, on the 9th September 2021 and defendant Kabba Kamara made an appearance on the 28th September 2021 for hearings.
The defendant Kabba Kamara after putting the charges to him pleaded not guilty to all counts charges levied against him.
Led in evidence by defense counsel, Martin Musa Kabba the son of the complainant, Martin Musa Kallon said he recognized both defendant Kabba Kamara and complainant Finda Kabba.
He confirmed that he is aware of land business agreement between complainant and defendant situated at Kerry Town.
He said he recalled sometime in 2021, when the witness the defendant Kabba Kamara refused to accept money from Finda Kabba for a plot of land he (Kabba) sold to his mother.
According to the witness, it was based on Kabba Kamara refusal to accept the remaining payment that his mother Madam Finda Kabba summons him to court for redress.
Another summon which was brought to court by Madam Finda Kabba, alleging that Kabba Kamara sold her land, has been thrown out of court by Magistrate Mark Ngegba.
Mr. Kabba Kamara, confirmed that he deliberately refused the money from Finda Kabba, because he did not trust her , as he suspected her to be unreliable.
He said as by agreement, he only sold one town plot to her and the remaining balance payment is five hundred thousand Leone.
Mr. Kabba Kamara said the only issue between him and Madam Finda Kabba, is when she “Finda” allegedly bypassed him (Kabba) and went ahead to save another one plot which Kabba he said was not part of their initial agreement.
“My lord , because I refused to signed a purported conveyance presented by Madam Finda that why she made such allegation against me by taking a court action after destroying all my plantation in my own property”, defendant said.
The matter of malicious damaged and trespass has been adjourned to the 16th November 2021.
