Judge Grant Le 500M Bail

Justice Monfred.M. Sesay (JA), a Judge of Appeal, has on the 6th October, 2021 granted bail to accused person, Ansu Fofanah 34 years, due to the failure of the prosecution to produce evidence in court. The accused person is before the court on one count indictment of murder contrary to the laws of Sierra Leone.

Addressing  the State Counsel, Justice Sesay said since the State Counsel is not ready to proceed with the matter and they have not also filed in an affidavit of opposition to bail he think it will be unquestionable for him to continue to keep the accused person on remand and in this circumstance bail is granted to the accused person with the sum of five hundred million Leones (Le5,000,000/00), with two sureties in life sum, each sureties should produce bid of real property in the Western Area, bail to be approved by the Master and Registrar of the High Court.

Justice Sesay cautioned the State Counsel that he must start the case as he needs evidence, if not he will discharge the accused person. The judge continued that because the State Counsel has failed to produce evidence that is the reason for granting bail to the accused person.

Responding to the judge the State Counsel, Joseph A.K. Sesay said he will come with witnesses on the next adjourned as he has been constrain to get his witnesses to access the court.

It could be recalled that the accused person Ansu Fofanah on the 9th September, 2018 at Freetown in the Western Area murdered Lamin Francis Fullah. The matter has been adjourned to the 12th January, 2022.
