The accused persons Musa Kargbo, Daniel Sesay, Foday Sesay and Balla Dabor made their first appearance at the High Court for pre-trial before Justice Monfred M. Sesay on the 23rd August, 2021. The accused persons were arraigned in magistrate court on a preliminary investigation and were charge with three count charges to commit a felony, house breaking etc.
While testifying in the High Court in Freetown, First Police Witness Detective Sergeant 7681 Kargbo H attached to the Criminal Investigation Departments Headquarter (CID) in Freetown, and told the court that he knew the four accused persons and can identified them. Witness said he has four warrants of arrest that he received on the 24th August, 2021 for the arrest for the four accused persons.
Witness said that the warrants of arrest are in respect to arrest the four accused persons, and states the specification of arrest for each of the accused person. PW2 said Musa Kargbo was charged with the offences of conspiracy to commit a felony accession after the fact. Witness continued to say accession after the fact to house breaking and larceny for the second, third and fourth accused persons.
Witness added that the last charge is for the first, second, third and fourth accused persons with the offence of conspiracy to commit a felony. Witness said that the names on the indictments were the persons he arrested.
State Counsel J.A.K. Sesay made an application for the trial to commence proper which was slated on the 23rdSeptember, 2021 and was sworn to by Solomon Christian Kekura dated on the 17th August, 2021. State Counsel continued to say that the affidavit in opposition he rely on paragraph four through eight inclusively.
Reading from the affidavit in opposition the State Counsel said the accused persons were before the court for three counts charges with the offences to commit a felony house breaking against the first accused person and accession after the fact to house breaking and larceny against the second, third and fourth accused persons and conspiracy to commit a felony against the four accused persons. He continued that the alleged money stolen from Dr. Sao Kpato Hannah Isatta Max-Kyne house is four hundred and fifty four million Leones.
Given his ruling Justice Monfred M. Sesay said he do not think it will be wise on his part to grant bail to any of the accused persons and if grant bail they may not turn up to stand their trial thereby causing injustice to the State. Justice Sesay refused to all accused persons and were remanded at the Male Correctional Centre. The matter has been adjourned to the 23rd September, 2021 criminal session.
