Magistrate Mark Ngegba of Pademba road court No1 has on Wednesday 14 September, 2022  committed the  allegedly  robbery  case at Wongor Mining company involving four accused persons  to the high court for further trial.

In his ruling after the defense counsel has waved his no case submission said evidence presented before the court by the Prosecution against the accused persons were not only sufficient but overwhelming.

He therefore committed the matter to the high court for trial.

Defense counsel Lawyer Jessie Jengo however intimate the court that he is waving his no case submission for the high court.

But however pleaded with the bench not withdrew the bail that was given to the accused persons.

Prosecutor  lawyer Yusuf Issac Sesay in reply said he is concerned with the bail granted to the accused person as he said the  offences for which they are in court was serious, adding that two of the accused persons are security in the said company.

He added that if they are to fulfil their bail conditions it will have a great effect on the operation of the company, noting that the complainant was expressing concern about threat from the accused persons.

 In the circumstance requested the bench to rescind their bail so that they can remain in custody.

He discloses that the attack by the accused persons was well planned and that the accused made confessional statement to the police in respect of the allegation.

Lawyer Yusuf Issac Sesay said the evidence before the court against the accused persons is overwhelming he therefore urged the bench to rescind their bail.

Magistrate Ngegba having listened to both sides granted the application of the prosecutor and rescind the accused persons bail for it to be determined by the high court.

It could be recalled that the accused persons Amadu Bello Mohamed Thailey aka bomb mint, Augustine Korfuma aka councilor, Boibe Gibnia Conteh and Daniel Samura aka one man geng were arraigned during preliminary investigation on four counts charges ranging from conspiracy to commit a felony contrary to law, robbery with aggravation, assault occasioning actual bodily harm and carrying offensive weapon without lawful authority and reasonable excuse all contrary to the laws of Sierra Leone.

The particulars of offence for count one state that all the accused persons on Friday 1st July 2022 at Wongor Mining international cooperation, Sierra Leone limited kumoroh village, in the Nimikoro chiefdom Kono District conspired together with other persons unknown to commit a felony to wit robbery with aggravation.

Police further alleged on count two that the accused persons on the same date and place being armed with cutlass and scissors, robbed Ruiping Chen a Chinese national a black bag containing four thousand four hundred and ninety eight point five four grams concentrate of gold substance valued $ 38,000USD and at the same time did use personal violence to the said Ruiping Chen.

Counts three and four stated that the accused Daniel Samura on the same date assault complainant in a manner thereby occasioning him actual bodily harm and was found carrying offensive weapon in a public place to wit cutlass and scissors without lawful authority or reasonable excuse.

The accused persons made 9 subsequent appearances in court before their committal and were granted bail prior to the committal but they were unable to meet the bail condition and had been in prison since then.
