Magistrate Kekura has on Thursday 29th July 22 Committed Gbessay Kargbo and Amadu Bailor Jalloh ‘alias Network for trail’ for an alleged conspiracy contrary to law and murder contrary to law.
The charges were read and explained to both accused persons but they did not take their respective plea because it is a preliminary investigation.
Magistrate Kekura said the brief fact is that both accused on Wednesday 9th March 2022, at Madonkeh village, Newton in the western area rural district conspired together with other persons unknown to commit a felony and murdered Ahmed Boil Kamara.
Delivering his ruling he said the prosecution in a bid to prove its case against both accused persons called five witnesses in evidence including formal witness who tendered various exhibits respectively.
All prosecution witnesses was cross examined by their defence counsel Nylender Esq the prosecution closed its case and the defence counsel submitted a written no case submission.
Magistrate Kekura further that his duty at this stage is to examine the evidence adduced before this court if there is sufficient evidence against the accused persons were in the matter will be committed to high court for trail, if there is in sufficient evidence against them the matter will be discharged pursuant to section 118 of the Criminal Produre Act No 32 of 1965.
Magistrate Kekura said in view of the above he is convinced that the prosecution has adduced sufficient evidence against both accused persons for them to stand trial at the high court and both accused to remain in custody
