Musa Kamara a security guard and Alusine Tarawallie a labourer yesterday sent to the male correctional facility by magistrate Mark Ngegba of Court No1 for allegedly stealing assorted items valued 281 million old Leones from Sunlight Trading Company.
The accused persons were arraigned on two counts charges ranging from Conspiracy to commit a crime contrary to law and larceny contrary to section 2 of the larceny Act 1916.
According to the indictment on count one, the accused Musa Kamara and Alusine Tarawallie on Monday 4th September 1023, at Sunlight Trading Company Sierra Leone Ltd Wire house at down Ferry Market Ferry junction Freetown conspired together and with other person’s unknown to commit a crime.
It was further alleged on count two that the first accused Musa Kamara on the same date and place stole six rolls of sisal fiber, ten cartoons of Anti Termite, four rolls of Paris cables, three rolls of 6mm Paris cables, eleven cartoons of diapers and several others assorted items all to the total valued of NLE 281,154/00 properties of Sunlight Trading Company Sierra Leone Ltd Wire house.
Both accused pleaded not guilty to the offenses when the charges were read and put to them.
Lawyer Hindolo Gevao objected to the offense of conspiracy on the grounds that it is bad in law, adding that it is not an offence for the court to seat on. Conspiracy on its own he said is not an offence noting that the crime was not spelt out.
First Prosecution witness (PW1) Jaikisham Soni led in evidence by Inspector Mabel Tarawally said he is a store keeper at the said sunlight Wire house.
He recognized the first accused person as his security and recalled 4 September 2023.
He said on that day the management decided to check the CCTV camera recording and when they did, they discovered that the following goods were missing valued 281,154/00 million old Leones.
At this juncture, the prosecutor Inspector Mabel Tarawally requested for a date to bring the said CCTV camera recording in court.
Lawyer Gevao applied for bail on behalf of the second accused pursuant to section 79 of the criminal procedure Act No32 of 1965.
Magistrate Ngegba refused bail and adjourned the matter to the 24th October 2023 for further hearing.
