Six Granted Bail Over Alleged Riotous Conduct and Malicious Damage

Six accused persons – Jaka Kakay, Abdulia Kargbo, Sakceleb Suluku, Alpha Seray, Tejan Magao, and Osman Kamara have made another appearance before Magistrate John Manso Fornah at Pademba Road Court No. 2 in Freetown, facing multiple criminal charges.

The charges include conspiracy to commit a crime, riotous conduct contrary to Section 12 (1) of the Public Order Act (as amended), incitement, and two counts of malicious damage contrary to Section 51 of the Malicious Damage Act 1861.

According to the prosecution, the alleged offenses occurred on Wednesday, 18 March 2026, at No. 2 Yusifu Drive, Vai S.S Camp, Regent, in the Mountain Rural District, Western Area.

The prosecution alleges that all six defendants conspired together, along with others unknown, to commit the offense of riotous conduct. It is further alleged that they behaved in a riotous manner and incited others to engage in similar conduct.

Additionally, the defendants are accused of maliciously damaging property, including an XRI mobile phone valued at Le 6,000, an iPhone 8 valued at Le 6,000, and an Apple iPad valued at Le 3,500, bringing the total value of damaged items to Le 15,500. The properties reportedly belong to Genevieve Caulker and Alberta Brewah.

When the charges were read and explained, all six defendants pleaded not guilty.

The prosecution, led by DPC 18235 Kabbie K Thoronka, called its first witness, Genevieve Caulker, a businesswoman. She testified that she recognized the first defendant as her landlady and knew the other accused persons.

She recounted that on the day of the incident; a confrontation occurred between her and the defendants. According to her testimony, threats were made, abusive language was used, and additional individuals were called to the scene, escalating tensions.

Defense counsel, S.I. Koroma Esq., applied for bail on behalf of all the defendants, arguing that they are Sierra Leonean residents within the court’s jurisdiction and have reliable sureties willing to stand on their behalf. The application was made pursuant to Section 76(1)(c) of the Criminal Procedure Act 2024.

Magistrate Fornah granted bail to all six defendants in the sum of Le 10,000 each, with one surety in like sum. The surety must reside in Freetown, have a fixed address, and present a valid identification card showing their address. Bail conditions are subject to court approval.

The matter has been adjourned to 8 April 2026 for further hearing.
