Alhaji Marah (accused) has been discharged for lack of witness on alleged Sexual Penetration of a girl below the age of consent. The accused Alhaji Marah is before Honorable Justice Suleiman Bah of the Sexual Model Court to answer to sexual Penetration contrary to section 19 of the sexual offence Act of 2012 No 12 of 2012 as Repealed and Replaced by Section 4 (A) (2) of the Sexual Offence (Amendment)Act 2019,Act No8 of 2019.

According to the particulars of offence, Alhaji Marah (accused) on the 9th August 2019 in Freetown engaged in sexual penetration with a girl Fatu Sesay (not her real name) below the age of consent.

Mentioning the file, the state prosecutor A.F Kamara applied that for the exigency of time and speedy trial, the state intend to offer no evidence against the accused person. He furthered that he has looked at the file and he found out that it is a committal file and no complainant on this matter, no victim and he has searched everywhere for the victim but to no avail.

A.F Kamara (state prosecutor) continued that considering the time the accused has spent in custody since 2019 to date he therefore, offered no evidence against the accused person at the dock.

The Bench in response to the application of the state counsel said having heard the application by the prosecution that they intend to offer no evidence against the accused person.

He therefore, discharged and acquitted the accused.

“You are free today so go home and be careful with what you are doing”, justice Bah said.

Meanwhile, the accused thanked the Honorable Justice Sulaiman Bah who told the accused also to thank the prosecutor.
