Justice Momoh Jah Stevens of the court of Appeal has on Friday 8th September 2023, granted bail to the convicted opposition Politician Mohamed Kamaraimba Mansaray pending his appeal.
He filed eighteen grounds of appeal immediately after his conviction.
Court of Appeals Judge – Justice Alhaji Momoh Jah Stevens granted bail in the sum of Thirty Million Leones (old Leones) as a guarantee not to be paid into the Court Account but by the surety if the Convict jumps bail.
This came after his lawyer Lawyer Emmanuel Saffa Abdulai moved a motion dated 6th September 2023 and asked that Kamaraimba be granted bail on the grounds that he is in critical medical condition.
He further told the court that bail is a discretion citing section 67(2) of the court Act 1965 which makes provision for the granting of bail as well, guided by statute, adding that the law allows for the court to grant bail on compassionate grounds.
Lawyer Yusuf Isaac Sesay for the respondent (state) did not opposed to the application for bail noting that they can only be prosecutors and not persecutors.
He underscored that if bail is granted to the convict, let there be speedy trial.
In the single Judge Appeal, Justice Steven said that the Surety must be resident in the Western Area, Mug shot or two pass port pictures of the Convict and his surety must be tendered in this Court and the Bail of the Convict to be approved by Deputy Master and Registrar.
Justice Stevens also ordered for speedy trial of the Appeal before him.
Kamaraimba after a prolonged rift and misunderstanding about his arrest late 2019 gave himself in to the police over allegations of sexually abusing a 15 year old girl in Kono district.
