Prosecution Fails to Present Exhibit in Larceny Matter

Magistrate Hadiru Daboh of the Ross road Magistrate Court should have delivered a ruling on an ongoing larceny matter which the prosecution has failed to present their witness.

After the prosecution led several witnesses but failed to present the exhibit clerk to tender the alleged stolen items, Magistrate Daboh informed the Court that he hate to delay such matters.

He therefore ordered the prosecution to present the exhibit clerk to tender the stolen items on the next adjourned date. He said failure to do so he will not deliver his ruling. He stated that the stolen items have already being in the custody of the police and that it would be unnecessary to delay the proceeding.

The accused Abdulai Kamara ‘alias L6’ was charged with one count of larceny contrary to section 14 of the larceny act 1916

It is alleged that on Friday 25th December 2020 at Approved School Market, Wellington, Freetown, he stole from Abu Swaray the following items; one blue black waist bag containing one hundred United States dollar equivalent to the sum of one  Million leones; one hundred and seventy thousand Leones, a pair of sun glasses, one mauve body splash, one black Teckno F1 mobile phone valued five hundred thousand Leones, and one blue-white mobile phone charger, all to the total valued of two million three hundred and twenty eight thousand Leones, property of the said Abu Swaray.

The accused was remanded and the matter was adjourned to the 26th March 2021 for ruling.  ASP Jeneba Bangura is prosecuting the matter.
