Police Witness D1098 B.Sama attached to the Law officer Process Cyber Subpoena Department in Freetown has testified before Justice Manuella Harding at the Modern Sexual Penetration Court in Freetown on 5th May, 2021. The witness said on the 20th October, 2020 he was duty when he received subpoena from Robin Mason Jr. to served Zainab Abdul Koroma who stood as surety for Muctar Jalloh the accused person.
Witness said he proceeded to Waterloo in search for Zainab Abdul Koroma but could not locate the address. He said he went back to the investigator to direct him but to no avail. Witness said he went back to Lawyer Robin mason Jr. and informed him his findings. The witness said he tried calling the phone numbers of Zainab Abdul Koroma all to no avail. The witness continued to say that the subpoena was signed by the Master and Registrar on the 16th October, 2020 and he went to find Zainab Abdul Koroma on the 20th October, 2020.
Under cross examination, defense Lawyer R.S.Bangura asked why the subpoena took long to reach the surety. The witness said he is the process server at the Law Officer Department and have many other documents to process. Defense counsel continued to ask if he inquired whether the accused person was at the Pademba Road correctional centre. Witness said it was not his duty. Defense counsel asked if the witness have cell phone. The witness said yes. Defense counsel asked if he ask for Zainab Abdul Koroma phone number. Witness said yes.
It could be recall that Muctar Jalloh the accused person was charged with one count of sexual penetration contrary to section 19 of the Sexual Offences Act 2012 Act No. 12 of 2012. The particulars of offence state that the accused person on the 20 August, 2019 at Freetown in the western area of Sierra Leone sexually penetrated a child.
The prosecutor for the case is Robin mason Jr.while Lawyer R.S.Bangura represented by the accused person. The matter has been adjourned to the 25th May, 2021.
