43 accused person’s that were arrested for September 11 protest in the East End of Freetown including Abubakarr Kargbo, Amidu Jalloh, Sulaiman Bangura, Ibrahim Sorie Sesay, David Johnson, Adama Conteh and 37 others on Thursday October 4th 2023, made their fifth appearances before Magistrate Hadiru Daboh of Court No.3 Ross Road, Freetown, to continue their trials.
The accused are on two files which the Prosecutor DSP Fatmata Kuyateh applied that both files with CS26/33 and CS 26/32 be consolidated as the action took place on the sane day and the offense on both files are the same.
Magistrate Daboh granted the application and the matter proceeded with a Police testifying.
In his testimony, the Police witness Constable 12144 Samba Jalloh attached to the Regional Criminal Investigation Department Freetown East.
He said he knows the complainant in the matter Inspector Osman Kamara and recognized the accused person’s. On Monday 11th September 2023, he was on duty at the Regional CID Department Freetown East, when Inspector Osman Kamara arrested and brought in the accused mentioned together with other people.
The matter was allocated to him for investigation, himself and DPC 18670 Bangura ML obtained caution statement from the accused persons separately. The witness furthered that DPC 18670 caution and question each accused people separately which they made responses separately in Krio and he recorded separately in English.
He furthered that at the conclusion of the interview of the accused person’s, he read and explained to them in krio separately and they admitted to be true and correct which they signed with their right hand thumb print.
On Tuesday 12 September 2023, himself and DPC 18131 Kargbo M obtained charge statement separately which they charged each accused person’s with the offences unlawful procession, incitement, disorderly behavior and riotous conduct DPC 18138 Kargbo M caution and question each accused separately in krio and they made responses separately which he recorded in English.
At the conclusion of the interview he read the charge statement to them separately in krio which they signed with their right hand thumb print.
Both caution and charged statement were tendered in court to form part of the court records.
The accused persons were refused bail.
The matter was adjourned to the 12th September 2023. DSP Fatmata Kuyateh is prosecuting the matter.
