Fatmata Jalloh has allegedly Wounded Isatu Bah contrary to law. The accused stands trial before the principal Magistrate,Magistrate Mark Ngegba Of Pademba Road Court No. 1 on three (3) count charges ranging from wounding with intent contrary to section 18 of the offence against the person Act of 1861,wounding contrary to section 20 of the act against the person Act of 1861 and Assault Occasioning Actual Bodily Harm contrary to section 47 of the same offence.
According to the particulars of offence, the accused Fatmata Jalloh on 16th June 2022 at the Criminal Investigation Department (CID) Headquatrs at Pademba Road Freetown did wound Isatu Bah with Intent to do her grievous bodily Harm and count two (2) and three(3) on the same place, date and time did wound and Assaulted the complainant Isatu Bah.
Testifying in Court Detective Sergeant 9416 Conteh A attached to the homicide Syndicate CID Headquarters led by Assistant Superintendent of Police IS Mansaray recognized the accused and the complainant.
She was on duty when a case of an enquiring file was handover to her for investigation by the complainant and she asked her to uncover her face when she saw her eye covered.
The witness said she gave the complainant a Police medical form which she later returned endorsed and on the same date 16 June 2022, she obtained voluntary question statement to the accused witness by Detective Inspector Vangawo.
She signed as the recorder the medical form was produced and tendered an exhibit B1-10, and photos of the incident was brought in and one of the eye swelling and receipt of the medical report.
The witness said she then issued a warrant to the accused person which they later arrested upon the warrant.
On the 18th June 2022, she charged the accused with three count of wounding with intent, wounding and Assault it was also witnessed by D Inspector Vangawo and she served as the recorder.
The prosecution witness no 3 ( PW3) Alpha Amadu Bah said he recognized the accused on this matter .He said, he was sitting at the reception at the CID Headquarters with her Mother, the complainant when she left him and went to the corridor. He continued that within that period he heard his mother crying and left the reception to know what happened with her. He said at the veranda, he saw group of Police officers trying to separate the accused from her mother and asked her when she told him that the accused did that to her.
Pw3 said the Police hold the complainant and went with her to the CID Headquarters which they later issued her a Police medical form which they took to the eye clinic at Connaught hospital for medical treatment and later made operation to the eye of her mother and took pictures of the operation with his phone which he later transformed into pictures of five.
He produced the phone and tendered it marked as exhibit E and the pictures exhibit F and made statement to the Police at CID Headquarters.
After pw3 the prosecutor intimated the court that they have closed their case
Both witness was cross examined by defense counsel Lawyer H. Tarawally and informed that court that they intend to do a no case submission on the next adjourned date.
The matter was adjourned to the 8th September 2022.
