The accused person Junior Fofanah of No. 35 Lumley Street Freetown appeared before Magistrate Sahr Keikura of Court No 1 in Freetown on the 15th June, 2021 at the Pademba Court in a case of prohibited drug, selling of prohibited drug and dealing in prohibited drug without lawful authority contrary to section 7(d) of the National Drugs Control Act, 2008.
According to police charged sheets, the accused person is charged with three counts of prohibited drug, selling of prohibited drug and dealing in prohibited drug without lawful authority contrary to the Laws of Sierra Leone.
It is alleged in count one that the accused person that on the 16th May, 2021 at No. 35 Lumley Street Freetown being sold a prohibited drug to wit forty (40) ties of cocaine weighing 6.9 grammes (6.9g) without lawful authority.
It is alleged in count two that the accused person that on the 16th May, 2021 at No. 35 Lumley Street Freetown being sold of a prohibited drug to wit forty (40) ties of cocaine weighing 6.9 grammes (6.9g) without lawful authority.
It is alleged in count three that on the 16th May, 2021 at No. 35 Lumley Street Freetown dealt wit a prohibited drug to wit one (1) sachet of heroin weighing 5.4 grammes without lawful authority.
Testifying in court the First Police Witness (PW1) Mohamed Ringo Bangura said that he recognized the accused person. He said he can recall on the 16th May, 2021 as the accused person was arrested and taken to the Transnational Organized Crime Unit (TOCU) office Hastings Freetown with some exhibits.
He said he conducted the investigation after which a document was handed to him that lead to charge the accused person to court. Lawyer I.T.Bangura asked for date to cross examine the First Police Witness (PW1). Lawyer prosecuting for the State is I.T.Bangura while there was no lawyer representing the accused person.
The accused person is remand at the Male Correctional Centre Pademba Road Freetown. The matter has been adjourned to the 21st June, 2021.
