On Alleged Murder: Motor Mechanic Remanded

Forty-Six Years Old Kabba Dumbuya A Motor Mechanic and business man made another appearance before Magistrate Santigie Bangura of Pademba road court No.2 in Freetown on two count charges to wit Murder and Incitement contrary to the laws of Sierra Leone.

According to the particulars of offence on diverse dates between 13th to 14th October 2023 at Finnah Drive off Benguema Road Waterloo, the western rural area in Freetown murdered Samuel Turay.

On count two on the above date and place the accused person unlawfully conducted himself in a violent manner thereby creating a scene that breach the peace against the family members of Farrah Turay that resulted to the unlawful killing of his younger brother, Samuel Turay.

 

When the charges were read and explained to the accused person, No plea was taken.

Sergeant 9155 Dwight Macarthy lead Prosecution witness number 2 Farrah Turay Military Officer 1882282 attached at the joint logistics unit Murray Town said he recognized the first prosecution witness as her mother and the deceased as his younger brother.

The witness said he recognized the accused person as his Neighbour.

He recalled on the 13th to 14th October 2023 something transpired between himself the accused person and the deceased.

On the above date his mother called and informed him that the district council had demolished structures that he was putting up.

The witness said when he off duty he went to the scene by then the road was blocked by his father he proceeded to the scene and took his family members inside the house.

The witness said the accused person and other people hit him with a stick on his side by then he saw his brother now deceased coming at the scene the accused person his wife and the other people hit the deceased with sticks the witness said he went to the Waterloo police station while he was at the said station he saw the deceased been brought to the station together with one John.

the police issue medical request form to him he went to community hospital while the deceased was taken to the Connaught hospital on the following day he received a telephone call that his brother passed away the medical request form was produced and tendered in court to form part of the court records.

Prosecution witness number three Timothy Turay a  pensioner said he recognized Prosecution witness number one as his wife, the deceased as his son and the accused person as his Neighbour.

he recalled on the above date at the city Council officer went and demolished his structure and he reported the incident to the police, the police came to the scene took snap shot of it the witness said around 7:00pm the accused came and scattered the sticks of barricade and said blood would be shed and there is going to be killing.

The witness said his wife PW1 called John Turay the accused person started confrontation where the accused person took sticks and hit John the deceased came to advise the accused then he started hitting the deceased on his head.

He collapsed the wife and relatives of the accused person rushed and beat the accused person all over his body, the deceased was taken to the Connaught hospital the witness said he later heared that his son is dead.

The witness said he witnessed the postmortem examination done at the mortuary home the postmortem result was produced in court to form part of the court records the witness said the deceased was buried later.

The witness was cross examined by defense counsel L.J Kamara Esq

Meanwhile Magistrate Bangura refused bail and sent the accused person to the male correctional facility in Freetown matter adjourned to the 29th January 2024 for further hearing.
