33yrs-old Nkai Kamara and 27yrs old Amara Nonkoh Kamara made another appearance before Magistrate Sahr Kekura of Ross Road Court No.1 in Freetown on two count charges to wit Malicious damage contrary to section 51 of the Malicious damage Act 1862 and public insult and provocation contrary to section 2 of the public order Act No.46 of 1965.
According to the particulars of offence on Monday 18th July 2022 at 18A Abdulai Lane Portee Wellington the western area in Freetown maliciously damage her make shift fence value one million Leones(1,000,000) on count two the first accused person in the view of the public did use certain insulting words against Haja Fatmata Dumbuya warranting her to commit a breach of the peace.
On their first appearance the charges were read and explained to the accused persons and they pleaded not guilty.
Deputy Superintendent of police Osman Bangura Led first Prosecution witness (PW1) Haja Fatmata Dumbuya a pensioner. PW1 said she recognized the accused persons as her neighbour and recall on the 18th July 2022. She said on the said date she was at home when she heard a strange voice commanding her son by the name of Mohamed Jalloh to tell one Abdul that he’s not supposed to throw dirt inside their compound.
The witness said one Alimamy was pleading on behalf of Mohamed Jalloh upon that the first accused person said don’t talk to that woman she’s a witch she has no right to run fence here, the witness said she saw her fence shaking and she saw the first accused person trying to destroy it and shouting “Arlakie Naba” upon that she went to Kissy police station and made report.
PW 1 said herself and the police officers visited the scene of crime; the police took photographs of the broken fence.
Photograph of the broken fence was produced for identification to form part of the court records. The witness said the broken fence cost one thousand Leones, the witness said she went with the police officers to the station and statement was obtained from her and her witness.
The matter was adjourned to the 28th January 2023 for further hearing.
