Murder Trial: Police Tender Exhibits in High Court

Mohamed Jagitay made another appearance before Justice Adrian Fisher at High Court No. 1, Siaka Stevens Street, Freetown, on a single count charge of murder, contrary to Section 1 of the Offences Against the Person Act 1861, as repealed and replaced by Section 1(a) of the Schedule of the Abolition of the Death Penalty Act 2022 (Act No. 6 of 2022).

According to the particulars of the offence, on 28th July 2023, in Freetown, Mohamed Jagitay allegedly murdered Ibrahim Jagitay.

When the charge was read and explained to the accused, no plea was taken.

State Prosecutor Musa Pious Sesay Jr. Esq. led in Prosecution Witness No. 7, Sergeant 8876 Issa Kamara, who is attached to the Exhibit Office at the Criminal Investigation Department (CID) Headquarters, Pademba Road, Freetown.

Sergeant Kamara testified that one of his responsibilities is to ensure the safe keeping of all exhibits related to cases under investigation and to present them in court when required. He recalled that on 11th September 2023, Inspector D. Mackieu, attached to the Homicide Syndicate, handed over to him the following items: an empty AirPods case, butcher knife with a black handle and a white mobile phone.

These items, he said, have remained in police custody since then. He produced and tendered them in court, and they were marked as exhibits to form part of the court record.

The witness was later cross-examined by defense counsel Muctarr Rashid Esq.

Meanwhile, Justice Fisher refused bail and remanded the accused at the Male Correctional Facility in Freetown. The matter was adjourned to 8th August 2025.
