MURDER ACCUSED CITED PROVOCATION FOR KILLING DECEASED

On the 31st February, 2021 Abioseh Maculey (deceased) died at his residence as result of multiple blunt surges and serious bodily harm on the neck. He died as a result of an attack by one Mr. Kallon.

The accused and the deceased had a misunderstanding; the accused picked up a stick with nails on it and unknowingly to Mr. Abioseh hit the deceased with it.

Mr. Kallon the accused was arraigned in court before Justice Amy Wright, the accused said the deceased said something that triggered his actions (provocation)

According to the particulars of the offence the accused Mr. Fredrick Kallon on the 31st January, 2021 committed murder by intentionally killing Mr. Abioseh Maculey causing serious bodily harm on the neck and multiple blunt surges on the neck.

First Prosecution Witness (PW1) a police officer attached at the criminal investigations department at the central police station said on the 31st January he was on duty when a transferred case of enquiry file together with the accused person was transferred.

He continued that having received the file a team of police officers headed by PC133931 and PC13260 left the station to visit the residence of the deceased off Ferguson street brook fields.

He said upon arrival at the residence of the deceased evidence was obtained, the deceased laid on the floor with blood oozing from his head, the scene of crime officers took photos of the deceased and conveyed the deceased at the Connaught mortuary for postmortem examination.

The prosecution witness furthermore stated that on the same day they visited the scene of crime at Becceles street Brookfield’s.

He said a concern citizen by the name of David Kanu identified a stick that the said accused used on the deceased.

Prosecution witness (PW1) said on the 4th February 2021 a postmortem test was conducted in the presence of the relatives of the deceased, and upon conclusion of the postmortem result by Dr. Simeon Owizz Koroma a death certificate was issued.

The prosecution witness explained that on the 5th February a voluntary caution statement was obtained from the accused witnessed by Sargent Marrah 9543 confirming that Fredrick Kallon ‘aka snoop’ assaulted Abioseh Maculey on the 30th January 2021 with a stick and died on the 31st January 2021.

In a voluntary caution statement the accused said he is a laborer in the field of construction and that he knew the deceased for the past 3years.

He said the deceased often provokes him in an insulting manner and involves others to do so, calling him boss ‘yai’

The accused told PW1 in his voluntary statement that on a Saturday he was at Becceles street market when Abioseh Maculey started provoking him and called him Bos ‘yai’ and the accused said he replied the deceased saying that God created him that way and told him that his condition was due to an accident he had.

The accused also said the deceased with some men provoked him and called him names and said the deceased told the men that the accused bos yai is as a result of his drunkenness and not accident and he repeatedly provoked the accused.

The accused continued in his statement that he chased the deceased first with a  dry fence stick and the deceased ran away but said the deceased still continued with the provocation and held his cloth and this angered him when the deceased was not paying attention he then picked up a stick and hit the accused.

The accused concluded in his statement that he had previously warned the deceased and reported the matter to his landlord and a woman by the name of Aunty Ramatu.

He was advised not to take the laws into his hands, the accused said when he hit the deceased he saw blood oozing from the deceased as he attacked him from the back and the deceased also sustained injuries on the neck.

The accused person was represented by defense counsel C Taylor Young, while the state was represented by VEA Kabia Esq and the matter has been adjourned to the 30th November 2021.
