John Sesay has made his first appearance before Magistrate Sahr Kekura of Ross Road Court No. 1 in Freetown for disorderly behavior contrary to law.
The accused appeared before the court for the offence of disorder behavior, insulting conduct and public provocative contrary to law.
It was alleged by the Inspector General of Police (IGP) that the accused, on 15th August 2023 at Dan Street in Freetown behaved in disorderly manner.
The charge sheet furthered that the accused, on the same date and place in Freetown, insulted and provoked Assistant Superintendent of Police (ASP) Abdul Razak Kamara for him to commit to breach of peace.
Led in evidence by Assistant Superintendent of Police (ASP) Mohamed B. Conteh first prosecution witness (PW 1) ASP Abdul Razak Kamara residing at Hill Cut, in Freetown attached to the Dan Street Police Post said he knew the accused and could recall 15th August 2023.
ASP Kamara said he was on duty at the Dan Street Police Post at around between 10 and 1am, while he was addressing a pending matter reported one Foday, involved the accused.
He said when he came few yard towards the post, the accused threw stones at the complainant, Amodu.
He said when the accused was about to throw the second stone, the first complainant, Foday grabbed him from behind which resulted into fighting.
PW1 said he and Inspector Sama separated them, disclosing that though he questioned and cautioned the accused, he was still violet towards them.
He said the accused told him that it was the first complainant who initially threw stone at him, but he was still trying to force his way towards the complainants, adding that warranted him to order his arrest.
He said the accused person made utterance saying that ‘he is not afraid of anyone, f**k to them.’
The witness said when he was arrested, his men engulfed the post and that prompted him to call upon the Local Unit Commander, (LUC) name withheld at the Ross Road Police Station, Harbour Division in Freetown.
Subsequently he said the matter was transferred to the Ross Road Police Station in Freetown for further investigations.
He said he then returned to the said post and made a statement.
Defence counsel Alie Santos Sesay applied for bail on behalf of the accused, assuring that his client is a Sierra Leonean residing in Freetown.
He further assured the court that the accused had reliable sureties willing and ready to enter into his cognizance.
Lawyer Sesay vowed that if the accused granted bail, he would not interfere with the prosecution’s witnesses.
Mr Sesay made his application pursuant to section 79 of the Criminal Procedure Act No. 32 of 1965.
Responding, Magistrate Kekura refused the accused bail and remanded at the Male Correctional Centre on Pademba Road in Freetown.
The matter was adjourned to 30th August 2023 for further hearing.
