Magistrate Kekura of Ross Road court No.1 has made it clear that if the witness who was supposed to come and prosecute Edward Gray on the next adjourned date slated for 17th April 2023, failed to show up, he would be left with no option but to discharge the accused.

The accused Edward Gray was charged to court after a police investigation for manslaughter with a case file number C/S 2728/ 2022.z

According to the police charge sheet, on Tuesday 20th September 2022, at No. 22 Old Railway Line Brima Lane, the accused unlawfully killed Damn Marie Fudia Mansaray his fiancée.

An abstract report in the police file stated that a report was made against the accused that at about twelve midnight, the accused assaulted his fiancée Ann Marie Fudia Mansaray and as a result of that she lost her life.

Shortly after the matter was mentioned, the prosecutor Assistant Superintendent of Police Osman Mohamed Bangura informed the Bench that he had made a frantic effort to bring in the witness but to no avail.

The prosecutor said he had contacted the witness on phone but it seems like he was not ready to come and face the court. Upon hearing that, magistrate Sahr Kekura said if the witness does not turn in on the next adjourned date, he would discharge the accused for want of prosecution.
