Man Arraigned for Alleged Malicious Damage of Electric Pole

First Police Witness (PW1) Samuel Akawa has testified before Magistrate Sahr Keikura of Court No.one on the 14th May, 2021 at the Pademba Road Court in Freetown. Samuel Yambasu was arraigned in court on one count of malicious damage contrary to section 51 of the Malicious Damage Act of 1861.

According to the police charge sheets, the accused person is charged with one count charge of malicious damage.

It’s alleged that the Samuel Yambasu (accused person) on the 6th April 2021 at Mile 13 village in the Freetown Western Rural of Sierra Leone maliciously damage one metal electrical pole valued six hundred and fifty thousand Leones (Le650,000/00) property of pastor Jaicy Sesay.

Testifying in court, witness said he knew the accused person and on the said date he was sleeping when someone woke him up and told him that the accused person is about to unlawfully uproot the electrical pole that is serving the community.

Witness said he left his room and met the accused person dug out the electrical pole. The witness said that the accused person told him that they should conspire to sell the electrical pole and share the money.  

PW1 told the court that, immediately he grabbed hold of the accused person, fighting ensued between them. He said someone then called out Pastor Jaicy Sesay. The witness revealed that the pastor took them to the Adonkia Police Station to make statement, while the electrical pole is currently at the Adonkia Police station as exhibit. The Police prosecutor is Police Constable 12090 Bangura Z.Y. while there was no lawyer representing the accused person. The matter has been adjourned to the 24th May, 2021.
