28yrs old Foday Kargbo has appeared before Magistrate Sahr Keikura of Pademba road court No.1 in Freetown on one count charge to wit Larceny contrary to section 2 of his Larceny Act 1916.
According to the charge sheet on diverse dates between 2nd July 2020 on the 18th August 2020 at Total fuel station Brookfield’s and Wilkinson road in Freetown stole eight hundred and forty liters of fuel valued five million eight hundred and eighty thousand Leones (5,880,000/00) property of Africell Mobile Company Sierra Leone limited.
PW3 inspector Alhaji Samson Thorley attached at the criminal investigation department Waterloo police station previously attached to Congo cross police station in Freetown testified that he knew the complainant and the accused person.
He recalled on the 21st August 2020 while on duty when the complainant arrived at Congo cross police station and made a report against the accused person and the matter was delegated to him for investigation on the same date.
The witness said he obtained statement from both complainant and witnesses. During the investigations the complainant handed to him quarry letters and has been in the custody of the police.
The witness further recalled a document he received from the complainant titled as fuel collection details for Africell vehicles with registration AMW 184 and AWE 262. The said documents have been in the custody of the police. The said document produced and tendered as exhibits D1-4.
Witness said recalled that he had invited the accused to Congo cross police station and he honored the invitation on the 1st of September 2020. The witness and detective Sergeant 1525 Sankoh Z obtained contemporaneous interview statement from the accused person, while detective sergeant 1525 Sankoh Z cautioned and questioned the accused person in krio language which he recorded down in English. At the conclusion of his statement it was read over and explained to the accused person in krio language. Accused is said to have admitted to it as being true and correct by appending his right hand thumb print.
The Lawyer representing the accused person James P Sesay cross examined the witness, while Sergeant 8998 Taylor MK is prosecuting the matter. The case has been adjourned to 20th May, 2020.
