35yrs old Alpha Amadu Bah “AKA” LAJ has on the 25th October discharged for wants of prosecution before Magistrate Sahr Kekura of Pademba road court No.1 in Freetown on one count of Assault occasioning actual bodily harm contrary to section 47 of the offences against the persons Act 1861.
According to the particulars of offence the accused Alhaji Amadu Bah on Saturday 5th December 2020 at the Golf club two police post, beach Road Aberdeen, the western area in Freetown assaulted John Yambasu in a manner, thereby occasioning him actual bodily harm.
The defence counsel, M Kallon applied that since the inception of the matter the complainant has never appeared in court and no progress has been made.
He applied that the matter be discharged for want of prosecution. The defence counsel M Kallon made his application pursuant to section 94 of the Criminal procedure Act No.32 of 1965.
Magistrate Sahr Kekura granted the application and discharged the accused person for wants of prosecution pursuant to section 94 of the Criminal procedure Act No.32 0f 1965.
Inspector I.G Fofanah was prosecuting the matter.
