Justice Fisher Orders APC to Hold Emergency Delegate’s Conference

The High Court Judge, Justice Adrian Fisher presiding over the case between Alfred Peter Conteh (plaintiff) and the Chairman of the APC and others has ordered the party to hold an emergency delegate’s conference.

The court orders the following: there shall be an emergency delegate’s conference technical planning committee that would consist of 21 members that would undertake the planning and preparation to the emergency national delegate’s conference. The third defendant shall nominate nine representatives, plus the chairman; the plaintiff shall nominate four representatives, one of whom shall be the secretary to the committee, three representations from the diaspora, and two representatives from the National Reformation Movement, two representatives from a group of contenders called Big Six.

The National Secretary shall coordinate and implement the decisions of the emergency delegate’s conference; the committee in exercising its mandate shall consult with the chairman of the fourth defendant. The court orders that the above parties shall nominate names and contact details of their nominees to the chairman of the fourth defendant, not later than 4 pm on the 11th August, 2021 and failing will lead to a nominate losing his right to vote . The secretary general shall publish a copy of the original draft constitution in two daily national newspapers with wide circulations, within seven days of this order.

The order continued to say that the second and third defendants shall ensure that the election for the 20 delegates for women’s congress, the 20 delegates for the youth league and the five delegates from each constituency shall be conducted no later than the 31st August, 2021. The second defendant shall forward to the chairman of the fourth defendant the final list of delegates for the emergency national delegate’s conference and to serve the same to the court and the solicitor for the plaintiff not later than 7th September, 2021.

The second defendant shall publish the final delegate`s list on the 8th September, 2021. That the second and third defendant shall hold an emergency national delegates  conference commencing on the 7th September, 2021 and to end on the 19th September, 2021.

The legal argument for an extension of time in the High Court injunction slammed within the All Peoples Congress party has finally come to end before the High Court Judge Justice Adrian J. Fisher.

Lawyer representing the plaintiff is J.M. Jengo, Lawyer A. Showers is representing the 1st defendant, Lawyer A.S. Sesay and R.A. Nylander is representing the 2nd defendant, A.K. Koroma, A. Macaulay and O.S. Kamara is representing the 3rd defendant respectively.

It could be recalled that the Court imposed injunction on the 26th February, 2021, restraining the party from conducting political activities. The following offices were restrained: the Advisory Committee, the National Secretary-General, The Assistant National Secretary-General, National Organizing Secretary, Assistant Organizing Secretary, the National Publicity Secretary, the Assistant National Publicity Secretary, the National Treasurer, the five Regional Chairman, the 16 district chairman, and the 132 constituency chairmen

The matter has been adjourned for the 4th October, 2021.
