Judge Threatens to Dismiss Kpaka Murder Trial Over Prosecution Delays

High Court Justice Alfred Ganda has warned he may discharge murder-accused Abdul Kpaka if prosecutors fail to appear at the next hearing, citing persistent delays in the trial over the death of his girlfriend, Sia Fatu Kamara.

The ruling at High Court No. 2 on June 17, 2025, followed an application by lead defense counsel Emmanuel Teddy Koroma to dismiss the case due to prosecution delays. Koroma argued: “Either discharge my client of these allegations, or close your case to allow the defense to present evidence.”

Notably, prosecution witnesses and jurors were present, but State Prosecutor Yusuf Isaac Sesay was absent. “We’ve been waiting since morning,” Koroma stated, contrasting the current delays with the prosecution’s efficient progress during earlier judge-alone proceedings before a different judge.

Justice Ganda then requested Sesay’s contact number from Koroma. After the judge personally dialed the number with no response, Koroma revealed: “I repeatedly called him myself and sent someone to his office – he was there but still ignored contact.”

Court records later showed Sesay had been present in the courthouse until noon but left for another trial while Justice Ganda was sitting in the Appeal Court.

Kpaka faces two charges: murder and perverting the course of justice relating to Kamara’s death on August 13, 2024. The case resumes June 24, 2025.
