Mohamed Johnson, Aiah Komba, Kalilu Fofanah, Victor Kellie and Ishmael Charles made another appearance before Magistrate Sahr Kekura of Pademba road court No.1 in Freetown on two count charges of Conspiracy contrary to law and Murder contrary to law.
According to the particulars of offence on Tuesday 20th April 2021, at Koidu Town in the Gbesseh Chiefdom in Kono Judicial District the Eastern Region conspired together with other persons unknown to commit a felony to wit Murder and on count two on the same date at the same place unlawfully murdered, Kai Osman Fengai.
Fifth Prosecution witness, Komba Fengai Sandy said whist she was in the vehicle Mr. Tamba Senesie was on the phone she saw the second accused person emerging from the left hand side of the road and he crossed over to the other end of the road, while the second accused person stood on.
The second accused person came closer to the vehicle, and started using abusive language “Basta pikin pull u mamie ass or dae cherr u mamie ass” (a child of a basted and other motherly invectives) they went further to say you Tamba Senesie and Honorable Emerson Lamina you are the one who said Sam Ansumana shouldn’t be president in Sierra Leone 2023, they have betrayed the cause of Kono the witness, explained the witness.
The witness added that Kai Osman Fengai (now deceased) and Sahr Boima alighted from the vehicle whilst the deceased was standing on the door of Mr. Tamba Senesie’ car the deceased advised the second accused not to used Abusive language if they have any issues let them go to the police station.
Second accused refused to listen to the 1st and 3rd accused persons who also came at the scene and started using motherly invectives. The accused persons said since Honorable Emerson Lamin said Sam Ansumana will not be president in Sierra Leone the deceased cautioned them for the second time and the second accused person said ” fuck off” while the second accused person left the scene and cross over to Tamba Tholley Veranda whilst the 1st and 3rd accused persons were still standing in front of the vehicle saying they will not go anywhere, narrated the witness.
The witness said she saw one Sahr Tholley coming towards them using motherly invective and he later saw the second accused person coming from Sahr Tholley veranda with a knife in his hand the second accused person was using abusive language on the mother of Tamba Senesie.
PW5 said the deceased was told not to come with the knife at the scene and he told the deceased to vacate the area. He pleaded with the second accused person to stand by but he moved backwards and stabbed the deceased on the left side of his chest.
Immediately, the second person left the scene while the 1st, 3rd and 4th accused persons were pelting the deceased with stones. The witness was cross examined by defense Counsel Jessie M Jengo, and Yusif Isaac Sesay was representing the State. Matter adjourned to the 12th November 2021.
