After nine appearances in court Honourable Komoh Sesay has been discharged by the Principal Magistrate Sahr Kekura for lack of evidence by the state prosecutor Yusif Isaac Sesay.
Honorable Komoh Sesay was before the court on two count of cyber stalking and cyber bullying contrary to section 44 (1) (a) of the cyber security and crime Act 2021.
Police alleged that the accused sometimes between March and April 2022, in the Portloko district Bakeloko chiefdom in the Northern province of Sierra Leone did wilfully communicates indirectly via public gathering with another person to wit the president of Sierra Leone Retired Brigadier Julius Maada Bio knowing that the said communication detrimentally affects the said person, Retired Brigadier Julius Maada Bio.
The Lead defense C.F Margai and Jesse M Jengo renewed his application for a discharge of the matter for want of prosecution.
Magistrate Kekura said since the inception of this matter before the court on 9th of May 2022 when the accused person was brought to court no single witness has been led so far by the State prosecutor Yusif Isaac Sesay and the accused have been appearing in court on every adjourned date irrespective of his health condition.
Magistrate Kekura further said in view of the aforesaid he hereby discharge this matter for want of prosecution pursuant to section 94 of the Criminal Procedure Act No 32 of 1965.
