At the Criminal session at the magistrate count No.2 held at Freetown on the 2nd February 2022 before Justice Abubakarr Binneh Kamara at the Judicial Week

State counsel Daisy Sawyerr said she learnt that the accused person died in custody at the Correctional center in Freetown and she asked for a discharge.  

Justice Abubakarr Binneh Kamara said the state counsel should not ask for the discharged of the matter because the person that has been the custodian of the death certificate has to tender it in court.

She applied that base on the prevailing circumstances that the cause of date certificate dated 21st October 2021 and number W/F38634, Cause of death dated 19th October 2021 signed by Doctor Tamba T Lebbie and death report of a trial inmate dated 23rd November 2021 signed by the acting regional commander of the correctional center to be produced to the court by the Correctional officers Corporal Edward K Bangura escort units Pademba road Magistrate court.

State counsel Daisy Sawyerr replied citing section 94 of the Criminal procedure Act No.32 of 1965

However, Justice Abubakarr Binneh Kamara granted the application for want of prosecution.

The deceased was charged with two count charges to wit Conspiracy contrary to law and Larceny contrary to section 14 of the Larceny Act 1916.

According to the particulars of offence on the 29th of October 2020 at 555 Spot Junction Waterloo in the Waterloo headquarter the western area in Freetown conspired together with other persons unknown to commit a felony to wit Larceny.

 On count two at the same place and date stole six hundred and fifty thousand Leones (650,000) property of Sallieu Kamara.
