For Lack Of Evidence…Accused Discharged Of Sexual Penetration

Justice Manuella Harding has on the 14th November at the Sexual Modern Offences Court,  discharged Samuel Sandy, after the court found him not guilty of sexual Penetration charges.

The accused was standing trial on a one count indictment of Sexual Penetration contrary to section 19 of the Sexual Offences Act 2012, Act No 12 of 2012, as repealed and replaced by Section 4 (a) (ii) of the Sexual Offences Act.

It was alleged that the accused on diverse dates of February 11 2020 at Kissy Road, Freetown sexually penetrated an 11 years old school going pupil and was arrested upon the allegation and the matter was charged to court, but was granted bail.

On the 14th November, the court came to a conclusion that the accused has been standing trial since the 25th May 2021 and no evidence or witnesses were brought to the court. Justice Manuella Harding gave her ruling and found the accused not guilty of the crime and discharged him from the allegation
