13 years old Moseray Kamara has narrated before Magistrate Samuel Bangura of Ross Road Court No.3 how one Ishmael Sesay stole the mobile phone of his father and fled.
Ishmael Sesay is in court on case file number C/S 734/2023 for a preliminary hearing on a count charge of larceny contrary to section 2 of the Larceny Act of 1916.
The particulars of the offence stated that on Saturday 18th March 2023, at No.43 Race Cross Road the accused steal one itel mobile phone worth one thousand eight hundred Leones belonging to complainant Abdul Alpha Kamara.
Taking the oath with the Holy Koran and led in his examination in chief by Sergeant 9095 Fonah HS, the witness Moseray Kamara residing at No.43 Off Race Cross Road, recognized the complainant and the accused person in court.
He said on Saturday 18th of March 2023, he was at home at around five in the morning his father’s complainant woke him up to go for prayers.
The thirteen years old said after performing ablution, his father instructed him to go to the mosque with his younger sister Musu Kamara.
After praying they return home and his younger sister was sleeping when the accused entered the house pretending as if he was their senior brother.
The witness said the accused went directly to the speaker box and took a mobile phone and ran outside. ” My Lord, I chase him and shouted thief, thief and a man who was attending nature in the next compound helped him to arrest the accused. He said by then the accused had already handed over the phone to his ally who fled with it.
The juvenile witness further explained that they took the accused home and called his father who came and ascertain that the phone has been stolen.
He said his father decided to take the accused to the police and on their way when his father questioned the accused, he admitted stealing the phone and further explained that whiles they were chasing him one of those who help to arrest him took the phone from him.
The witness said at the police station he was asked to make a statement in connection with the alleged incident.
The accused who was unrepresented cross-examined the witness who confirmed seeing him stealing the phone and during the incident, he was putting on a green and white cloth. The witness also confirmed in court that all that he told the court was the exact thing that happen that day.
At the end of the cross-examination, the matter was adjourned to the 24th of May 2023 for the prosecution to take his next witness.
