Due To ill Health… 64yrs old man granted Le100m bail

The Presiding magistrate at Pademba road court No.1, Sahr Keikura has last Friday granted 100 million Leones bail to one Sanpha Thoronka, age 64, who was reported sick.

When the matter was heard in court, the accused person was not able to stand straight in the duck, so magistrate Kekura asked what was wrong with the accused, his defense counsel J.T Mansaray stood up and told the Bench that his client has been suffering from serious illness for the past one week whilst in detention.

However, the prosecutor was ready to proceed with the matter because his witness was present in court.

“I will not proceed with the matter today because of the health condition of the accused and I am also a human being,” Magistrate Keikura said.

In that circumstance, Lawyer J.T Mansaray renewed his application for bail, noting that his client is a Sierra Leonean with fixed abode and in serious health condition. He said if granted bail he will have access to his private medical doctor. He canvassed his bail plea, citing Section 79(2) of the Criminal Procedure Act No. 32 of 1965.

He said if bail is granted to his client, he will not interfere with witnesses and that he has reliable sureties that were ready and willing to enter into his recognizance, adding that his client will not jump bail if granted.

After making his bail application, Lawyer Mansaray produces the medical report of the accused to show the bench the status of his client health condition.

Meanwhile, Magistrate Kekura said after hearing the bail application of the defense counsel and peruses the medical report of the accused, he therefore granted bail to the accused in the sum of one hundred million Leones, plus one surety who must be resident in the western Area and he or she must produce identification card, depicting his or her address in Freetown while the bail bond should be approved by the Deputy Assistant Register.

The accused person has made his sixth appearance before Magistrate Kekura on one count of using of electricity supply contrary to section 68 of the National electricity Act No. 16 of 2011.

Police prosecutor, Sergeant 9155 Marcathy alleged that the accused on Friday 2nd July 2021, at Madina, Back of Cockril, Freetown, fraudulently used electricity supply from the Electricity Distribution and Supply Authority (EDSA) to be diverted to the said house within Cockril.

The matter was adjourned to Tuesday 10th August 2021.
