Detective Superintendent Testifies In Alleged House Breaking

Detective Police superintendent 10007 Josephus Musa attached to the Andonkia Police Station yesterday 15th March 2023 testifies in court for an alleged house breaking of one Jabati Gendemeh. 

The accused Person is before Hon. Justice Dombosco Alieu in court for three count charges of house breaking and Larceny Contrary to section 26(1) of the Larceny Act, 1916.

According to the offences, it was alleged that on 10th January 2019 at Freetown in the Western Area of Sierra Leone broke and entered the dwelling house of Emmanuel Mohamed Kamara with intent to steal and stole therein physical cash in the sum of Le 15,000,000 (Fifteen Million Leones) property of Emmanuel Mohamed Kamara.

Count Two, the accused Jabati Gendemeh was also on 10th January 2019 at Freetown in the Western Area of Sierra Leone broke and entered the dwelling house of Emmanuel Mohamed Kamara with intent to steal and stole therein six pairs of sneakers all valued Le2, 100, 000 (Two Million One Hundred Thousand Leones) property of Alusine Eward Conteh in the side dwelling house.

Count Three, the accused Jabati Gendemeh on 10th January 2019 at Freetown in the Western Area of Sierra Leone broke and entered the dwelling house of Emmanuel Mohamed Kamara with intent to steal and stole therein one Tecno Spark 5 mobile phone value at Le 2.500,000 (Two million Five Hundred Thousand Leones) property of Emmanuel Kanu in the said dwelling house.

He told the court that he recognized the accused person in the dock, and recalled on 10th January 2019 he was on duty when one detective sergeant Conteh brought the accused person at the Adonkia Police Station handed over to him the exhibits including one blue mobile phone which have one million Leones orange money intact, one black bag, black T-shirt and sum of Seven Hundred and Nine Leones.

He said that after receiving the exhibit from inspector Conteh, he handed it to the exhibit clack.  

Police detective stated that together with the senior crime officer visited the scene of crime and photo was also taken, he said.

He said at the scene the senior crime was hand over to him a CD plate that contained the CCTV footages of the accused person.

He narrated that from the scene of crime they returned to the Adoinkia Police Station with the side exhibit which was also hand over to the exhibit clack.

He said upon arrival at the police station him together with D.P.C 19688 MO obtained statement from the complainant on 11th January 2021, adding that statement was also obtained from the accused person which was recorded in English.

PW3 Marie Kamara, complainant and also wife of Emmanuel Kamara told the court that she is a Business woman.

She told the court that she recognized the accused person in the dock as a closed neighbour and recalled on 10th January 2021, she was on their way from  church service together with he’s husband and three kids when a  neighbor shout at them that the accused person has again have stolen their property.

She said his husband tried to chase the accused but he flew away, adding that they went in to their house and saw some of their property have gone missing, adding that he decided to view the CCTV camera and the said accused was spotted in the footages.

She said they called the accused father to tell him that his son came to their house for the third time and stole various items, to which she said the accused Father replied that he could not believe but after review of the  CCTV couldn’t say much rather than insist for the complainant to go ahead with the case.

She narrated that later she called inspector Conteh and reported the matter who went in search of the accused and he was brought to the station

Hon. Justice Dombosco Alieu adjoined the mater to 5th April 2023, order the exhibit clerk to tender the exhibit to the court on the adjourned date.
