Defense cross-examines witness in Kono Murder Matter

Defense counsel, lawyer Sahid Sesay on Friday continued his cross-examination of the third prosecution witness in the ongoing preliminary Investigation into the alleged Kono murder.

Police alleged that Mohamed Johnson, alias birthday after birthday, Aiah Komba, Kalilu Fofanah, Victor Kellie, and Ishmael Charles on Tuesday 20th April 2021, at Koidu Town in Freetown, murdered Kai Osman Fengai.

These accused persons were faced with two counts charges of conspiracy to murder, and murder contrary to law.

Prosecution witness, Tamba Senesie, had started testifying before Magistrate Sahr Kekura in the matter. In his testimony he revealed that the deceased was stabbed by the second accused person in his presence, adding that it was he who conveyed the deceased to the hospital where he was pronounced dead.

After his testimony, during the last sitting, lawyer Sahid Sesay had already started cross-examining the witness, when Magistrate Sahr Kekura requested that the matter be adjourned. During Friday’s sitting, lawyer Sahid Sesay continued his uncompleted cross-examination.

When the witness was asked the direction the accused persons went when the deceased came down from the vehicle following alleged insulting remarks to the prosecution witness. The witness responded that the deceased moved towards the left side of his car door, whiles the accused persons were at the back of the vehicle.

The witness also confirmed that he stopped talking on the phone before he came down the vehicle to convey the deceased to the hospital, but the accused said he stopped the phone conversation before coming down the vehicle to convey the deceased to the hospital.

When he was asked if he knows whether the accused persons had any relationship with the deceased, the witness said he doesn’t know. Lawyer Sahid Sesay suggested that because the witness was concentrating on his phone call, he didn’t know why the second accused left the scene of crime.

More witnesses are expected to testify in the matter as indicated by the State Prosecutor. Meanwhile, Magistrate Sahr Keikura remanded the accused persons, and he adjourned the matter to the 13th August2021.
