Supreme Court Judge, Hon. Justice Allan B Halloway has on the 19th July 2022 in agreement with two court of Appeal Judges, Hon Justice Jamesina King and Hon. Justice Komba Kamanda admitted Randa Skaikay to bail pending the hearing and determination of the Appeal filed by Lawyer Mohamed Pa Momo Fofanah.
The Application was filed by Lawyer Mohamed Pa Momoh Fofanah on behalf of the Appellant/Applicant to bail.
The Appellant/Applicant according to the notice of motion of the Appeal that on the 14th June 2022 the Appellant/Applicant Randa Skaikay was convicted of two counts of the offence of Larceny in a dwelling house contrary to section 13 (a) of the Larceny Act 1916 and the offence of Larceny by Servant contrary to section 17 (1) (a) of the Larceny Act 1916 respectively and sentenced to 3 years on each count aforesaid, the same to run concurrently.
Therefore the Court holds it view that the likelihood of the Applicant frustrating the progress of the Appeal is very much possible, when once she is admitted to bail and by reason of the above order it was ordered that the Appellant/Applicant be admitted to bail on the following conditions met.
That the said Appellant/Applicant shall procure two sureties who shall each enter into a recognizance of the sum of One Billion, Five hundred Million Old Leones or the Sum of One Million Five Hundred Thousand New Leones notes and that the two sureties must be Sierra Leoneans, residents in Sierra Leone who are property owners in Sierra Leone of the same value and sureties must be approved by the Master and Registrar.
That the Appellant/Applicant shall surrender her passport and all other travelling documents in her possession to the Master and Registrar of the court, the same to be kept by the Master and Registrar until the determination of the Appellant’s/Applicant’s appeal the said Appellant/Applicant shall not leave Sierra without an Order from the Court.
And in conclusion that the said order shall be served by the Chief Immigration Officer for the purpose of him ensuring that Appellant/Applicant is not issued with a new passport other than the ones she would have deposited at the Court and for the purpose also for him distributing to all border posts and entry points from Sierra Leone to ensure that the said Appellant/Applicant do not leave the shores of Sierra Leone.
And that speeding hearing of the Appeal is ordered and must be settled within 3 weeks from the said Order.
