Police Witness (PW2) Esther Kamara a house wife has testified before Justice Suliaman Bah at the Modern Sexual Penetration Court in Freetown on the 21st April, 2021 in sexual penetration matter between Tamba Amadu Gborma the victim and Gibrilla Jalloh alias Blacker (accused person).
The witness said she recognized the accused person and on that fateful day the witness said she was having her bath while she looked through the balusters window in the bathroom where she saw the accused person and the victim and noticed their usual behaviors. PW2 said she saw the accused person directing the victim to an unfinished building that was protected with sticks and that what prevented the accused to access the place.
As she was observing them, the witness said she saw the accused person using the frontage of the house to enter the building. She hurriedly took her bath to see first-hand what was going on. On her way out way she met Fatmata Koroma coming to collect something from her kitchen but she immediately indicated to her by using her finger to follow her.
They both entered separately in the unfinished house where she saw the accused person holding the victim throat with his one hand, while the other hand was used to put the erected penis into the mouth of the victim. She shouted “Fatmata look at him and the accused person pushed me to the wall, while Fatmata hit him with the fire spoon; he then jump through the window and ran off” She narrated.
She said the victim was unconscious at the time and they took him to the hospital. She said she later reported the issue to the police and made statement. On that day the entire community was on the lookout for the accused person; while a certain man reveal his identity to them.
Under cross examination, Defense Lawyer Morrison Karimu asked that if she knew the accused person before the time of the incident, her response was that it was during this matter. Defense Counsel further asked if the witness met the accused person on the alleged sexual penetration act, she said she only saw the accuse putting his penis in the mouth of the accused person.
The witness said she did not see the accused person on the act but something fishy was happening and that was why she followed them. The witness said she was taking her bath when she saw the accused person and the victim entered an unfinished building.
Counsel Alberta Kargbo represented the State while Lawyer Morrison Karimu. Matter has been adjourned to the 5th May, 2021.
