31yrs old business man Chernoh Mamaju Jalloh made his second appearance before the Principal Magistrate Shar Kekura on pademba Road Court No.1 in Freetown for an alleged Conspiracy to defraud one Kadiatu Kamara that she will travel from Sierra Leone to Canada.
The accused was before the court on two charges to wit Conspiracy to defraud Contrary to Law and obtaining money by false pretences contrary to section 32(1) of the larceny Act 1916.
Police alleged that the accused Chernoh Mamaju Jalloh on a date unknown between 1st September 2021 and 20th September 2021, at sackilla street Freetown with intent to defraud conspired with other persons unknown to commit a felony to wit obtaining money by false pretences. And on the same date the accused obtained the Sum of three thousand United state dollars equivalent to the Sum of thirty nine million six hundred thousand Leones (Le 39, 600, 000.00) from Kadiatu Kamara by false pretending that you will facilitate her travelling from Sierra Leone to Canada knowing same to be false.
Kadiatu Kamara a business woman testified before the principal magistrate that she recalled on the said date and the accused person in respect of the case.
Koroma said one Shiaka Sannoh introduced her to the accused that he has program which he will allow someone travelled to Canada.
She stated that she and Sannoh met the accused at No.60 Sackvilla street Freetown. The accused is to facilitate the program to Canada that “I should give him the sum of eight thousand United state dollars” and further add that the accused asked her to deposit the sum of three hundred thousand United state dollars.
The witness said that on the 20th of September 2022 she gave the sum of three thousand united state dollars at No 60 Sackvill Street in the Presence of Sannoh and the accused gave her receipt in return.
She said the accused told her that within five months the program will materialized and she will go to Canada.
The receipt of payment was produced and tender in court as exhibit A. to form part of court records.
The witness said after five months she and Sannoh went to the accused to know the way forward but the accused did not respond nor did he say any tangible word with regards her travelling to Canada, witness narrated.
The witness said she made report at the Criminal Investigation Department (CID) Headquarter Freetown.
The witness was cross examined by Defense Counsel L.W Jalloh, while Sergeant 9939 Lahai M prosecuting.
Matter adjourned to the 13th of July 2022.
